1. PURPOSE & ACCEPTANCE
This Online Banking Agreement (“Agreement”) governs your access to and use of CLICO Credit Union’s electronic and internet-based banking services (“Online Banking” or “Service”).
By selecting “I Acknowledge and Agree”, you:
- consent to be legally bound by this Agreement;
- acknowledge receipt of all disclosures;
- agree to CCU’s Membership Terms, Account Terms, Fee Schedule, Privacy Notice, and all product-specific disclosures.
Your electronic acceptance constitutes a legally binding electronic signature under the Electronic Transactions Act, Chap. 22:05. CCU will store your selection for its records.
If you do not agree, you must not access or use the Service.
2. DEFINITIONS
“ACH” (Automated Clearing House)
Means the electronic clearing and settlement system used in Trinidad and Tobago for processing batch electronic credit and debit transfers between participating financial institutions.
“Agreement”
Means this Online Banking Agreement & Disclosure, including all schedules, notices, policies, amendments, and related disclosures referenced herein, as updated from time to time.
“Business Day” / “Business Time”
Means any day on which CLICO Credit Union is open for business, being Monday to Friday, excluding public holidays in Trinidad and Tobago, during the following hours:
- Main Office: 7:30 a.m. – 3:00 p.m.
- Piarco Branch: 8:30 a.m. – 4:00 p.m.
“CCU”, “CLICO Credit Union”, “we”, “us”, or “our”
Means CLICO Credit Union Co-operative Society Limited.
“Credentials”
Means all security information used to access Online Banking, including but not limited to User ID, password, personal identification numbers (PINs), one-time passwords, authentication codes, security questions, biometric identifiers (where applicable), and any Multi-Factor Authentication method.
“Electronic Signature”
Has the meaning assigned under the Electronic Transactions Act, Chap. 22:05, and includes any electronic symbol, process, or action executed or adopted by you with the intent to sign or accept this Agreement or any instruction, consent, or transaction.
“Instruction”
Means any request, order, authorisation, consent, or direction provided by you through Online Banking, whether financial or non-financial, including but not limited to transfers, payments, service requests, applications for products or facilities, acknowledgements, and updates to personal or account information.
“Member”, “you”, or “your”
Means any individual or entity that is a member of CLICO Credit Union and is authorised to access and use Online Banking.
“Multi-Factor Authentication (MFA)”
Means an authentication method that requires two or more verification factors to confirm your identity, which may include something you know (such as a password), something you have (such as a device or token), or something you are (such as biometric data).
“Online Banking” or “Service”
Means CCU’s internet-based and electronic banking platform, including any website, mobile application, software, or system that allows you to access accounts, transmit Instructions, receive communications, apply for products or services, and conduct transactions electronically.
“RTGS” (Real Time Gross Settlement)
Means the real-time electronic funds transfer system used in Trinidad and Tobago for high-value or time-critical payments, processed individually and settled immediately between participating financial institutions.
“Secure Inbox” / “Secure Message”
Means the encrypted electronic messaging facility within Online Banking used for confidential communications between you and CCU.
“Third-Party Service Provider”
Means any external entity engaged by CCU to support Online Banking, including but not limited to payment systems, telecommunications providers, hosting providers, software vendors, and clearing or settlement systems.
“Transaction”
Means any financial or non-financial activity initiated or completed through Online Banking, including but not limited to transfers, payments, balance inquiries, service requests, applications, and confirmations.
“User ID”
Means the unique identifier assigned to you or selected by you for the purpose of accessing Online Banking.
3. ACCESS & AVAILABILITY
Online Banking is generally available 24 hours a day, subject to:
- system maintenance,
- events beyond its control (e.g. natural disasters)
- cybersecurity events,
- third-party service interruptions,
- regulatory or operational constraints.
CCU does not guarantee uninterrupted or error-free service.
Requests submitted outside cut-off times or on non-Business Days are deemed received on the next Business Day.
System Requirements & Maintenance
- You need an internet‑enabled device and a supported browser.
- CCU may perform maintenance; notices will be posted in advance when feasible.
4. SCOPE OF SERVICES
Subject to eligibility and approval, Online Banking may allow you to:
- view balances and transaction history;
- transfer funds within CCU and to third-party financial institutions;
- submit payment and transfer instructions;
- communicate securely with CCU;
- apply for loans, credit facilities, or ancillary services;
- update personal or account information;
- receive notices, disclosures, and confirmations electronically;
- provide legally binding instructions and acknowledgements.
CCU may add, modify, suspend, or withdraw features at any time.
5. TRANSACTIONS, LIMITS & PROCESSING
- Transactions are processed based solely on the information you submit.
- Once executed, transactions may be irrevocable.
- CCU may impose limits, holds, verification steps, or delays.
- Insufficient funds or compliance concerns may result in declined transactions.
- Transfers may not be instantaneous and are subject to system availability, verification procedures, and third-party financial institution processing rules.
- By initiating a transfer, you authorise CLICO Credit Union to process the payment exactly as entered and acknowledge that the Credit Union may rely on your electronic instructions and confirmations as legally effective under the Electronic Transactions Act.
- Service features depend on your account type(s) and CCU’s eligibility criteria.
6. SECURITY & MEMBER RESPONSIBILITIES
You are solely responsible for:
- Safeguarding your credentials, devices, and MFA methods;
- Reducing risk by:
- Use strong, unique passwords and MFA.
- Keep your device OS/browser up to date; install reputable anti‑virus software.
- Log out after use; do not access Online Banking on public/shared computers.
- Never share credentials, one‑time codes, or click suspicious links (phishing/smishing).
- Use the secure message feature for sensitive account inquiries.
- Promptly reporting suspected fraud or unauthorised activity.
- Ensuring the accuracy of all instructions; You are responsible for ensuring that all transfer details are correct, including, but not limited to, the Payee name, Payee account number, Receiving financial institution (if applicable), and Transfer amount. CLICO Credit Union will process the payment based on the information you submit, and once sent, the transaction may be irrevocable and cannot be recalled.
By selecting ‘Transfer’, you authorise CLICO Credit Union to process this transfer on your instructions and acknowledge that CLICO Credit Union is not liable for losses resulting from incorrect details entered by you, except as required by law. If you believe there is an error or unauthorised activity, please contact us immediately.
This transaction may be subject to security, regulatory, and legal compliance checks which may delay or prevent processing where required by law.
CCU is not responsible for losses arising from:
- phishing, social-engineering, SIM-swap attacks,
- compromised credentials due to your negligence,
- unauthorised access where security instructions were not followed.
7. FRAUD REPORTING & UNAUTHORISED TRANSACTIONS
Suspected errors or unauthorised transactions must be reported immediately.
Delays in reporting may result in increased losses for which you may be responsible. Your cooperation (e.g., affidavits, device/network details) may be required. Notifying CCU promptly helps limit losses and expedite resolution.
CCU reserves the right to:
- suspend access,
- place holds,
- conduct investigations,
- require supporting documentation.
CLICO Credit Union is not responsible for losses arising from incorrect information provided by the member, acts or omissions of third-party financial institutions, or circumstances beyond its reasonable control.
8. NO ADVICE DISCLAIMER
Information provided through Online Banking is for general informational purposes only and does not constitute financial, investment, accounting, or legal advice.
You are responsible for obtaining independent professional advice before acting on any information.
9. PRIVACY & DATA USE
By using Online Banking, you consent to CCU collecting, using, storing, and processing personal data including:
- login credentials,
- device identifiers,
- IP addresses,
- transaction and behavioural data,
- fraud-monitoring analytics,
In accordance with applicable laws and CCU’s Privacy Notice.
CCU will:
- Collect data lawfully, for specified purposes, and limit disclosure to what is necessary to deliver the Service or as required by law.
- Apply reasonable safeguards to protect your data and electronic records.
- Provide channels to update/correct information and to make privacy inquiries.
10. ELECTRONIC RECORDS & NOTICES
Electronic offer and acceptance, records and communications have the same legal effect as paper documents. CCU may deliver notices electronically unless law requires otherwise.
Where a transaction, application, or service does not require an express “I acknowledge and agree” selection, your completion of the relevant electronic process, including clicking to proceed, submit, accept, or confirm, constitutes your intentional and binding acceptance of the applicable terms and instructions.
These electronic actions are legally effective and enforceable as if executed by handwritten signature. CCU may provide related contracts, notices, statements, and disclosures electronically through the Service or to your registered email.
CCU will maintain an audit trail of your electronic acceptance.
12. SUSPENSION & TERMINATION
CCU may suspend or terminate Online Banking immediately where required by law, security concerns, breach of this or other Agreements or ineligibility of account.
Notice will be provided where practicable.
You may cancel this service at any time by secure message and/or written notice.
13. LIMITATION OF LIABILITY & INDEMNITY
To the fullest extent permitted by law:
- CCU is liable only for losses caused by its gross negligence or wilful misconduct.
- CCU is not liable for indirect, consequential, or third-party losses.
- You agree to indemnify CCU against claims, including third party claims, arising from your misuse of the Service.
14. CHANGES TO THIS AGREEMENT
CCU may amend this Agreement and will provide notice of material changes. Continued use after the effective date constitutes acceptance.
15. GOVERNING LAW & JURISDICTION
This Agreement is governed exclusively by the laws of the Republic of Trinidad & Tobago. The courts of Trinidad & Tobago have exclusive jurisdiction.

17. MEMBER CONSENT
